Toxic tort situations can sometimes become well known, such as with exposure to asbestos, which causes mesothelioma and other lung disease, lead paint, which causes brain damage, and toxic landfill/spill waste, which causes leukemia and other illnesses. Toxic Substance Regulation

Since 1976 all toxic substances are strictly regulated by the Toxic Substances Control Act (TSCA). This was created in order for the EPA to monitor the 75,000 kinds of industrial strength chemicals created and used in the United States. The EPA requires testing of chemicals that could pose an environmental or human health hazard. If a chemical poses more than acceptable levels of risk the EPA can have it banned. Even with testing and regulation people are still being exposed to chemicals at work and at home throughout the country. 

Challenges in Toxic Tort:

An unfortunate reality with toxic tort cases are they are often not brought on until years after the exposure to toxins. Many do not realize what they are exposed to, or effects of such exposure, until years later. It is often especially harmful to industrial workers who would be exposed over a course of potential years to the toxic substance. In cases of environmental contamination the toxins have affected large groups of people. This causes many toxic tort cases to be brought as class action lawsuits, when a group of affected parties come together to see compensation for damages.
